Scope of Application

The terms and conditions contained in this document shall apply to the relationship between the visitor/guest (hereinafter referred to as the “Guest”) and the Grandratur Lda “MEU HOTEL Porto Gandra” from the moment the reservation is requested until the end of the period of accommodation at the hotel.

In the event of any omissions in the Terms and Conditions, the Portuguese legislation in force will apply.

 

1. Conclusion of the Contract

  1. When requesting a room the Customer makes an accommodation offer to Grandratur Lda. “MEU HOTEL Porto Gandra”. If rooms are available, Grandratur Lda. “MEU HOTEL Porto Gandra” will provide the Customer with a reservation code.
  2. The Customer is informed that when booking rooms with Grandratur Lda. “MEU HOTEL Porto Gandra” through third parties (tour operators or internet room reservation portals) a different booking code will be issued from the one directly issued by Grandratur Lda. “MEU HOTEL Porto Gandra”.
  3. Requests for room reservations made directly to Grandratur Lda “MEU HOTEL Porto Gandra” or through third parties are not binding and do not oblige Grandratur Lda “MEU HOTEL Porto Gandra” to enter into a contract with the Customer. Grandratur Lda. “MEU HOTEL Porto Gandra” will always have the right to refuse to enter into a contract and make rooms available at its sole discretion.
  4. MEU HOTEL Porto Gandra” only guarantees the Customer the provision of a room of the reserved category and not the provision of a specific hotel room.

 

2. Types of Bookings and their cancellation

  1. At “MEU HOTEL Porto Gandra” the Customer can make two types of reservations, “simple” reservations and “guaranteed” reservations.
  2. A “simple reservation” is the booking of a room at “MEU HOTEL Porto Gandra” without making any prior payment by the customer or providing a means of payment.
  3. Guaranteed reservation consists of a room reservation at “MEU HOTEL Porto Gandra” accompanied by the Customer providing valid and complete credit card details, or a reservation accompanied by proof of a bank transfer of the total price of the accommodation reserved.
  4. A Simple Booking may be freely cancelled by the Customer, free of charge, up until 4 p.m. on the day of booking.
  5. A Simple Reservation will automatically expire if the Customer does not show up at the hotel by 4 PM on the day of booking, in which case Grandratur Lda. “MEU HOTEL Porto Gandra” may immediately make the room available to any other Customer without the Customer who made the reservation being able to claim any compensation from Grandratur Lda.
  6. The guaranteed reservation may be freely cancelled by the Customer until 4pm on the day of booking without any costs being charged.
  7. If the guaranteed reservation is cancelled under the terms of the previous number and the Customer has already paid the price – under the terms of the final part of number 3 of this clause – Grandratur Lda. “MEU HOTEL Porto Gandra” will refund the amounts paid.
  8. If the request to cancel a Guaranteed Reservation is made after 4pm, the Customer will be charged the price due for the room on that day, the reservation being null and void on the day immediately following, the same applying if the Customer does not show up on the day of the Reservation without having, in due time, cancelled the reservation made.

 

3. Check-in and Check-out

  1. MEU HOTEL Porto Gandra” will provide the Customer with a room of the reserved category upon arrival or, if the Customer has not made a reservation and contracts the accommodation at the hotel reception, according to the desired category and according to hotel availability, in principle from 3pm and at the latest from 5pm on the day of check-in.
  2.  At check-in, the Customer must immediately pay the price of the room, number of nights’ stay and additional services.
  3.  Upon full payment, Grandratur Lda. “MEU HOTEL Porto Gandra” will provide the Client with a code to access the room that will remain valid during the contracted stay.
  4. At check-out the Customer must leave the room unoccupied of people and goods and without any damage until 12 noon.
  5. If the room is not vacated by 12 noon on the day of check-out, a compensation corresponding to the price of one night’s stay at the hotel will be charged immediately, and the Customer will only be entitled to use the room during that period if the hotel has room availability, otherwise the Customer must pay the compensation and leave the room as soon as possible.

 

4. Animals

  1. It is strictly forbidden to house animals at “MEU HOTEL Porto Gandra”.
  2. The introduction of animals in the hotel by the Customer will allow Grandratur Lda. “MEU HOTEL Porto Gandra” to immediately terminate the contract with the Customer and force him/her to leave the hotel without refunding the amounts paid for the room during the contracted stay.

 

5. Terms of use

  1. Only the persons indicated in the accommodation reservation will be entitled to use the hotel room.
  2. Customers must treat the hotel room with care and consideration.
  3. The Customer must treat other hotel guests with good manners and respect the hotel rules posted in the hotel, if applicable, which are also part of the accommodation contract.
  4. The Client is not permitted to cook food brought in, either in the hotel room or elsewhere on the hotel premises.
  5. Children under 14 years of age must be supervised by an adult Client at all times during their stay at the hotel.
  6. The Customer is recommended not to keep or leave without any money, valuables or other valuable items left in the hotel room or in vehicles parked at “MEU HOTEL Porto Gandra”.
  7. Grandratur Lda “MEU HOTEL Porto Gandra” has a central safe in the hotel where valuables can be kept, as long as they are duly identified in the appropriate document.
  8. Grandratur Lda “MEU HOTEL Porto Gandra” does not assume any responsibility in the event of theft, loss or deterioration of valuables which take place in the hotel room or inside the vehicles parked in the hotel car park.

 

6. Access to the hotel room by Grandratur Lda. “MEU HOTEL Porto Gandra”.

MEU HOTEL Porto Gandra” and its employees will have the right to enter the hotel room, during the Customer’s stay, in order to carry out cleaning, repairs and similar works.

 

7. Price of the stay and other prices

  1. The price of the stay to be paid by the Customer constitutes the consideration for the provision of the use of the hotel room, in the period between the arrival and departure.
  2. The total price of the stay will be charged per night, regardless of whether the Renter actually made use of the room or spent the night there.
  3. The applicable rates are the agreed prices or the price indicated in the MEU HOTEL Porto Gandra price list in force on the date of conclusion of the contract. Grandratur Lda “MEU HOTEL Porto Gandra” shall have the right to increase or reduce prices if a period of more than four months elapses between the date of the booking by the Customer and the date of arrival or if any taxes, visitor contributions or other charges are changed or introduced.
  4. The rates and amounts stated in the terms and the accommodation contract are all plus VAT unless expressly stated otherwise.

 

8. Payment terms

  1. Amount of the stay and prices for additional services must be paid in advance, at the time the Customer arrives at the hotel, regardless of the billing date.
  2. If the length of the Customer’s stay is not specified, the price of the stay and prices of additional services for each night must be paid in advance by 12 noon.
  3. In the case of stays without a specified departure date, failure to pay the price of the stay and additional services under the terms set out in the previous number determines immediate termination of the contract and obliges the Client to vacate the room and hand it over to Grandratur Lda. “MEU HOTEL Porto Gandra” free of people and goods and in good condition.
  4. Charges for additional services within the meaning of no. 1 will be, for example, charges for the car park, breakfast prices, and other charges that are not expressly mentioned in the accommodation contract, which are part of the price of the stay.
  5. Grandratur Lda. “MEU HOTEL Porto Gandra” accepts payment in euros, transfers, CE Maestro, Visa Electron and the credit cards: Visa and MasterCard. The American Express card is not accepted.

 

9. Complaints relating to material defects

  1. The Renter must inspect the hotel room on arrival and immediately report any defects and anomalies to the hotel reception.
  2. Any defects that appear during the stay must be reported to the hotel reception as soon as the Customer becomes aware of them.
  3. If a defect is found in the Customer’s room, Grandratur Lda. “MEU HOTEL Porto Gandra” has the right to choose between its repair and reallocating the Customer to a room that has at least the same category as the one contracted with the Customer.
  4. For the above-mentioned purposes, only serious defects susceptible of jeopardising the level of service and quality of Grandratur Lda. “MEU HOTEL Porto Gandra” are considered, Grandratur Lda. “MEU HOTEL Porto Gandra” not being obliged to take any action in case of irrelevant or unreasonable complaints or if they are related to details that do not conflict with the minimum level of service contracted.
  5. Should Grandratur Lda. “MEU HOTEL Porto Gandra” be unable to repair the relevant defect or replace the Guest’s room with another of an equivalent or superior category, the Guest may only terminate the contract and receive the price paid for the room, being unable to claim anything else from Grandratur Lda.

 

10. Liability on the part of Grandratur Lda.

  1. MEU HOTEL Porto Gandra” will only be liable for damages or losses suffered by the Client when such facts result from the culpable action of Grandratur Lda.
  2. MEU HOTEL Porto Gandra” does not accept any liability for the loss of data provided by the Customer in the event of electronic transmission of payment details and will only be liable to the Customer in the event of fault.
  3. MEU HOTEL Porto Gandra” does not assume any responsibility for damage or accidents that may occur inside the room or any other part of the hotel unless such accidents are caused by the fault of Grandratur Lda.
  4. MEU HOTEL Porto Gandra” will not be held responsible towards the Client in the event of a delay in the availability of the room and there is a valid reason for the room not being available on time.
  5. For the purposes of the previous paragraph, valid reasons are considered to be those that make it impossible or more difficult to provide the room, such as strikes, lockouts, natural disasters, accidents in the room or in the hotel.
  6. In the event of a delay in the availability of the room beyond 7pm on the day of booking, the Client may freely terminate the contract without having the right to claim any compensation from Grandratur Lda.
  7. MEU HOTEL Porto Gandra” does not assume any responsibility for acts carried out by any of the hotel’s employees, unless they are in their normal working hours, properly identified and uniformed as company employees.
  8. Grandratur Lda. “MEU HOTEL Porto Gandra” does not assume any responsibility nor can it be held responsible for the non-fulfilment of accessory obligations.
  9. MEU HOTEL Porto Gandra” cannot be held responsible for the act or omission of any other Guest, even if this is likely to cause damage or loss to another Guest of the hotel. Any and all damages caused to third parties by Clients of the hotel will be the exclusive responsibility of the latter and completely alien to Grandratur Lda “MEU HOTEL Porto Gandra”.
  10. MEU HOTEL Porto Gandra” will not be liable to the Client for any loss of profits or indirect damages even if these result from failure to comply with a principal obligation.

 

11. Duty to notify

  1. In the event of theft or damage to property or, in the event of fire, water damage or other damage to the hotel room, the Customer must immediately inform the hotel staff and do everything possible to help resolve the theft or repair the damage.
  2. 12. Termination of the accommodation contract
  3. Grandratur Lda. “MEU HOTEL Porto Gandra” has the right to terminate the accommodation contract if the Customer does not pay the price in full and on time when due or does not provide the required guarantee.
  4. The Customer may give notice of termination of the accommodation contract during their stay at any time up to 7pm, to take effect from 12 noon on the following day.
  5. Any contracting party may terminate the accommodation contract summarily for cause.
  6. Grandratur Lda. “MEU HOTEL Porto Gandra” shall have the right to immediately terminate the accommodation contract for just cause if the Customer has any behaviour that affects the good coexistence, quiet or hygiene of the hotel, namely if during their stay in the hotel, the Customer is under the influence of drugs or alcohol, uses the hotel room for prostitution practices, acts offensively towards the hotel staff or other hotel customers, disturbs the peace of other hotel customers, or in the past has made malicious false bookings and/or damaged or destroyed the hotel or its facilities.

 

12. Data protection

  1. The Customer is informed that his/her personal data will be stored and processed by Grandratur Lda “MEU HOTEL Porto Gandra” and made available to Grandratur Lda “MEU HOTEL Porto Gandra” associated companies and selected service providers, in accordance with the Law, for the purposes of contract execution, for services towards the Customer and for its own advertising campaigns.
  2. The Customer grants Grandratur Lda “MEU HOTEL Porto Gandra” the right to use associated companies and selected service providers to perform data processing and the right to transmit such personal data under this section to companies that allow them to store and process it.
  3.  The Customer has the right to object at any time to the use of personal data for advertising purposes, and to do so must express their intention in writing to Grandratur Lda “MEU HOTEL Porto Gandra” to the hotel address “MEU HOTEL Porto Gandra” / Avenida Central de Gandra, 1460 / 4585-116 Gandra PRD. or by e-mail: portogandra@meuhotel.pt
  4. Unless otherwise legislated, the Customer’s personal data must be deleted when the accommodation contract ends and the statutory retention periods have expired.
  5. Full details of data protection policy can be obtained from “MEU HOTEL Porto Gandra” / Avenida Central de Gandra, 1460 / 4585-116 Gandra PRD.

 

13. General Provisions

  1. The Terms and Conditions fully regulate the Customer’s stay at the hotel and the Customer’s use of the room.
  2.  No verbal agreement has been reached throughout the accommodation contract all and any changes to the contract between the parties will necessarily have to be contained in a written document signed by both parties, unless it is a unilateral statement, in which case it must be contained in a written document signed by the issuer.
  3. MEU HOTEL Porto Gandra” will have the right to have third parties carry out their obligations under and in the scope of the accommodation contract.
  4. The invalidity of one or more of the preceding provisions shall not affect the validity of the remaining provisions. The invalid provision will be replaced by the valid provision, the closest to the commercial and legal intentions of the parties or if this is not possible by the Portuguese legislation in force.

 

14. Special conditions applicable to group reservations

  1. The term “group” is understood as the booking of at least 10 rooms by a group of persons travelling or staying together. The “group” shall be bound, in addition to the general obligations, to the specific fulfilment of the obligations contained in this clause.
  2. The group must appoint a spokesperson (“leader”) to liaise with “MEU HOTEL Porto Gandra”.
  3. The “Leader” must deliver to “MEU HOTEL Porto Gandra”, prior to arrival at the hotel, a complete list containing the detailed identification, residence and mobile phone contact of each of the group members.
  4. Upon making a reservation the leader will receive a booking confirmation from “MEU HOTEL Porto Gandra”, containing the details of the reservation made together with check-in details and details to secure the reservation and any other payment conditions.
  5. Group bookings are always automatically guaranteed reservations.
  6. The group must pay the total amount of the stay charges by bank transfer to Grandratur Lda “MEU HOTEL Porto Gandra” bank account indicated on the booking confirmation or notified by Grandratur Lda “MEU HOTEL Porto Gandra” to the leader on completion of the booking. The group will reimburse Grandratur Lda. “MEU HOTEL Porto Gandra” for any charges incurred due to external transfers in full, no later than at check-in.
  7. The group’s stay, including supplementary service charges must be paid in advance, with 50% of the payment due one month before and the remaining 50% fifteen days before the group’s check-in date, in both cases, regardless of the billing date.
  8. The group can cancel the reservation free of charge up to 15 days before the date of arrival at the hotel, in which case Grandratur Lda. “MEU HOTEL Porto Gandra” will refund the group all amounts paid in the meantime.
  9. If the cancellation is made at least 7 days before the arrival date the group will be charged the price of one night’s stay in each of the booked rooms and if the cancellation is made less than 7 days before the arrival date Grandratur Lda. “MEU HOTEL Porto Gandra” will charge the group the total price of the booked stay.
  10. Grandratur Lda. “MEU HOTEL Porto Gandra” will book hotel rooms of the agreed category or with the agreed facilities for the group on the date of arrival according to availability, generally from 3pm, but in any case no later than 5pm.
  11. Grandratur Lda. “MEU HOTEL Porto Gandra” will be entitled to require a deposit of €500 per group on the arrival of the group at the hotel which it will keep as a security deposit.
  12. The group must receive an invoice for the stay, which will be given to the “leader”.
